Wealthsimple’s Account Guarantee

A. Our Guarantee: Wealthsimple Investments Inc. (“Wealthsimple”, “we”, and “us”) will reimburse you for 100% of any Monetary Losses that you incur in your Accounts that arise directly from Unauthorized Transactions made while using the Wealthsimple Digital Platform, provided that you have enrolled in and use Passkeys on all your Devices and you meet all of your Security Responsibilities as outlined in this Guarantee and the terms of our Agreements. 

B. Security Responsibilities: You are eligible under the Guarantee for reimbursement of Monetary Losses arising from Unauthorized Transactions in your Account provided that you:

  1. have enabled Passkeys on all of your Devices and you use and keep your Passkeys active at all times;

  2. immediately report the loss, theft, misuse or compromise of your Credentials to us upon becoming aware of such loss, theft, misuse, or compromise using the contact information provided at Section C of this Guarantee; 

  3. report suspicious, unauthorized or fraudulent activity on your Accounts to us immediately, but in any event within ten (10) days of receiving your monthly Account statement containing the Unauthorized Transaction, using the contact information provided at Section C of this Guarantee; 

  4. comply with all of your obligations under the Agreements and any additional instructions we provide you to keep your Accounts secure, such as resetting passwords and following any security alerts or warnings;

  5. keep your Credentials secure and do not voluntarily share them with any other person or organization and are not otherwise negligent or careless in keeping your Credentials confidential and secure;

  6. only access the Wealthsimple Digital Platform on a Device that is secure and contains up-to-date operating systems and software, including anti-virus and firewall software, and otherwise take steps to ensure your Device is free from malware and viruses;

  7. do not use a Device that contains software that has the ability to reveal or compromise your Credentials, including but not limited to use of a Device that contains malware;

  8. do not voluntarily allow another person or organization to use or access your Device or otherwise allow any person or organization to access your Device through the use of remote desktop or screen sharing applications;

  9. do not engage in any fraudulent, criminal, dishonest or negligent acts related to the Unauthorized Transaction, your Accounts, your Credentials, and/or the Wealthsimple Digital Platform;  

  10. fully cooperate with any investigation by Wealthsimple or law enforcement, including with any reasonable requests for information or documents, or to file a police report regarding the Unauthorized Transaction, and any requirement to sign a Wealthsimple loss declaration form;

  11. have not carried out the transaction, including if the transaction is a result of any mistake, error, omission, or inaccuracy in any data or information that you give to us; and 

  12. have not consented to, contributed to, or authorized the transaction in any way.

C. Reporting Unauthorized Activity: You must contact us immediately at 1-855-255-9038 or by chat on the Wealthsimple Digital Platform when you notice any unauthorized activity on your Account(s) or if your Credentials have been compromised. 

D. Limitation of Liability: This Guarantee does not apply to, and Wealthsimple is not liable for, any indirect, consequential, special, aggravated, punitive, or exemplary damages, in whole or in part, including without limitation any missed payments, non-sufficient funds and other administrative fees, business interruption, loss of profit, data, information, opportunity, revenue, or goodwill, or any other economic or commercial loss resulting from an Unauthorized Transaction, regardless of the cause of action and even if we were advised of the possibility of such damages. 

E. Amendments: Subject to applicable law, Wealthsimple reserves the right to amend, modify, or revoke this Guarantee in its sole discretion at any time. If notice is required to be provided under applicable law, such notice may be provided through the Wealthsimple Digital Platform or by otherwise communicating with you electronically. This Guarantee is subject to the Agreements, provided, however, that if there is any conflict between the terms and conditions of this Guarantee and those of the Agreements, the terms of conditions of this Guarantee will prevail. 

F. Definitions: The following definitions apply to this Guarantee. 

  1. Account” means all personal accounts you hold at Wealthsimple, including any individual and joint accounts, such as chequing accounts, non-registered and registered trade and managed accounts, crypto accounts, portfolio line of credit accounts, and margin accounts, but does not include any credit card, corporate, or Wealthsimple Predict accounts or self-custody wallets you may hold.

  2. Agreements” means the agreements governing your use of your Accounts, available here

  3. Credentials means the login credentials you use to access the Wealthsimple Digital Platform, such as your Account number(s), registered e-mail address, password, 2FA codes, or Passkey(s). 

  4. Device means any mobile phone, tablet, laptop, or desktop computer that you use to login to the Wealthsimple Digital Platform. 

  5. Guarantee” means this Account Security Guarantee. 

  6. Legal Representative means any person (a) named as your Power of Attorney for property and in Quebec, any person named as a mandatary in a mandate; (b) an estate representative; (c) a legal guardian and, in Quebec, a curator; or (d) any other person recognized as your legal representative under applicable law or by a court order and who is authorized to have access to your Account. 

  7. Monetary Losses” means all direct financial loss that you incur in your Accounts that arise directly from Unauthorized Transactions made through the Wealthsimple Digital Platform. It does not include any loss or damage excluded under Section D of the Guarantee. 

  8. Passkeys” means the passkey tool provided by Wealthsimple for login use on the Wealthsimple Digital Platform. 

  9. Security Responsibilities means the items described in Section B of this Guarantee. 

  10. Unauthorized Transaction” includes any online or mobile transaction made in an Account through the Wealthsimple Digital Platform that occurs without your authorization, consent, permission, or knowledge, where it can be established that you are the victim of fraud or theft and that you fulfilled all Security Responsibilities set out in Section B of this Guarantee while using passkeys, leading to Monetary Losses in your Account. This includes: (a) when your Credentials have been compromised or stolen; or (b) transactions that occur after you have notified us that you believe your Credentials may have been compromised or of any suspicious, unauthorized or fraudulent activities on any of your Accounts. For greater certainty, an "Unauthorized Transaction" does not include any transaction carried out in your Account by any Legal Representative or person acting under any authority to trade or transact in your Account or to otherwise act on your behalf.

  11. “Wealthsimple Digital Platform” means Wealthsimple’s mobile app and website. 

  12. You”, “your”, and “yours” means the individual or individuals, in the case of joint accounts, listed on the Account and their Legal Representative, if applicable, as well as any authorized trader that is authorized to trade on the Account.
